These Terms of Service (“Terms”) govern your use of https://four-fox.com (the “Website”) and the software development, web design, and related creative services offered by Four Fox (“Four Fox,” “we,” “our,” or “us”). By using the Website, submitting a form, or engaging us for services, you agree to these Terms and to our Privacy Policy at https://four-fox.com/privacy-policy. If you do not agree, please do not use the Website or our services.

Quotes are estimates until you accept them in writing. Fees, payment schedules, and the number of revision rounds included in a project are stated in your proposal or agreement. Unless your agreement says otherwise, invoices are due by the date shown on the invoice, and work outside the agreed scope may be quoted and billed separately.

You agree to provide accurate information, timely feedback, and the content, files, and access we reasonably need to complete your project. You confirm that you own or have permission to use any text, images, logos, or other materials you give us. Delays in providing materials or feedback may affect project timelines.

Unless your project agreement states otherwise, ownership of final deliverables transfers to you once all amounts due for the project have been paid in full. We keep ownership of our pre-existing tools, code libraries, templates, and methods, and may reuse general know-how gained during a project. We may display completed work in our portfolio unless you ask us in writing not to.

You agree not to misuse the Website, including by attempting to gain unauthorized access, interfering with its operation, submitting false or harmful content, or using it for unlawful purposes. The content and design of the Website belong to Four Fox or its licensors and may not be copied or reused without permission.

Who we text: Only prospective and existing clients who have opted in to receive
texts from us. We do not text purchased or third-party lists.

How you opt in: You opt in by checking the optional, unchecked SMS consent box next to the phone number field on our contact form at https://four-fox.com/get-in-touch . You may also start a text conversation by texting us first, and we will reply only about your request.

Types of messages: Customer support replies, responses to inquiries and quote requests, appointment reminders and scheduling updates, project status updates and design review links, and invoice reminders. We do not send promotional or marketing text messages through this program.

Message frequency: Message frequency varies depending on your interactions with us, typically 1 to 5 messages per conversation.

Costs: Message and data rates may apply, depending on your mobile plan.

Opt out: You can cancel text messages at any time by replying STOP to any message. After you reply STOP, we will send one confirmation message and you will receive no further texts from this program. If you opt out, we may still contact you by other means, such as email or phone, about your project.

Opting back in: If you opted out and want to receive texts again, reply START to a message from us or submit our contact form with the SMS consent box checked.

Consent is not a condition of purchase: You do not have to agree to receive text messages to buy or use any of our services.

Carriers: Wireless carriers are not liable for delayed or undelivered messages. Message delivery depends on your carrier and device.

Privacy of your mobile information: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties, except aggregators and providers of the text messaging services needed to deliver our messages. The Website and our services are provided “as is” and “as available.” To the fullest extent permitted by law, Four Fox disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, Four Fox is not liable for indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the Website or our services. Our total liability for any claim related to a project will not exceed the amount you paid us for that project.

You may stop using the Website or end a project in line with your project agreement. We may suspend or end access to the Website or our services if you breach these Terms or misuse our services. Sections that by their nature should continue after termination, including intellectual property, payment, disclaimers, and limitation of liability, will continue to apply.

These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-law rules. Any dispute that we cannot resolve informally will be handled in the courts located in Maricopa County, Arizona, unless your project agreement says otherwise.

We may update these Terms from time to time.
